Chișinău City Hall clarifications following Tuesday’s fire in a residential building in the capital

Following the fire that occurred on Tuesday in a residential building in Chișinău, the City Hall issued clarifications after several media institutions requested a response.

The City Hall states that, according to current legislation, local public authorities do not participate in the final acceptance of privately funded constructions.

According to the Regulation on the acceptance of construction works and related installations, approved by Government Decision No. 285/1996, the acceptance of privately funded construction works is carried out by the investor and the contractor through the establishment of an acceptance commission.

For residential buildings with more than 5 floors, investors are required to include in the commission a representative of the State Construction Inspectorate, currently the Inspectoratul Național pentru Supraveghere Tehnică, an institution under the Government of the Republic of Moldova.

Starting from 2025, the mentioned regulation was repealed by Government Decision No. 726, and construction acceptance is now regulated by the Urban Planning and Construction Code.

According to the Code, city halls do not participate in the acceptance of private constructions, while, under Article 197, the Inspectoratul Național pentru Supraveghere Tehnică participates in the acceptance of constructions, including residential buildings with more than 5 floors.

At the same time, according to Government Decision No. 360/1996, state control of construction quality is carried out at all stages of construction and use, and, according to Government Decision No. 391/2023, the Inspectoratul Național pentru Supraveghere Tehnică ensures state supervision of fire safety measures.

Chișinău City Hall insists on being included in acceptance commissions, as most questions in such situations are addressed to the local public authority, while responsibility is often shifted between central authorities.
